Terms and Conditions
Central Coast Washing Machine and Refrigerator Repairs will provide a tax invoice to the Client for the appliance repair services after the completion of the agreed repair job
A standard 10% GST will be included in the Tax invoice
Clients to pay Central Coast Washing Machine and Refrigerator Repairs in return for the appliance repair services the fees in cash, via EFTPOS or electronic bank transfer to the nominated bank account within seven working days of Central Coast Washing Machine and Refrigerator Repairs delivering a Tax Invoice to the Client
The Tax Invoice will include a brief description of the appliance repair services provided and such other information like supporting checklist etc. that the client may require.
The client is entitled, as a pre-condition to any obligation to pay Central Coast Washing Machine and Refrigerator Repairs , to request that Central Coast Washing Machine and Refrigerator Repairs provide the client with such further or other information or documentation as it may reasonably require in order to satisfy itself that the appliance repair services have been carried out as per agreed and that the fees for such appliance repair services as calculated on the Tax Invoice is true and correct and properly represents the appliance repair works completed.
Central Coast Washing Machine and Refrigerator Repairs undertakes, represents to and covenants to its clients that the Central Coast Washing Machine and Refrigerator Repairs team:
- has the necessary knowledge, experience and expertise to provide the appliance repair services in a professional manner
- will do all things necessary to ensure that it performs the appliance repair services at all times in a safe and competent manner
- will do all things necessary to ensure that its authorized representative/s if any is available as and when reasonably required by the client in order to perform and carry out those appliance repair services
- will follow all directions given by the client or any authorized person engaged by the client from time to time in respect of performing the appliance repair services
- will carry out the appliance repair services to a standard satisfactory to the client and at such places as the client may require
- will complete all of the appliance repair services in a timely manner and in accordance with any times reasonably requested by the client
- will ensure that the appliance repair services provided be of a quality reasonably acceptable and to the satisfaction of the client
- will promptly provide from time to time such information as the client may reasonably require concerning the appliance repair services
- will not do or fail to do anything that amounts to Misconduct on its part and/or which might cause the client to be liable in tort, contract or liable under any Act, including any claims or liability pursuant to the Trade Practices Act 1974 (Cth) and/or any relevant State Fair Trading Act or any other consumer legislation
Central Coast Washing Machine and Refrigerator Repairs promises and undertakes to the client/s that any of its authorized representative/s will at all times in the course of carrying out his or her duties will:
- Act diligently, ethically, soberly and honestly;
- Not take or use any drugs unless prescribed by a medical practitioner or lawfully available without prescription and used in accordance with directions ;
- Not by act or omission commit any criminal offence ;
- Not act negligently or carelessly;
- Not consume alcohol whilst providing the appliance repair services nor perform those appliance repair services under the effects of alcohol
Central Coast Washing Machine and Refrigerator Repairs will ensure that all of its authorized representative/s will comply with all applicable OH&S policies of the client including but not limited to those relating to a smoke free work environment also all procedures, rules, regulations, standards of conduct and lawful directions of the client in respect of the use of the client’s facilities and in the communications and dealings with the client
Central Coast Washing Machine and Refrigerator Repairs will ensure that any of its authorized representative/s does not sexually harass any employee or unlawfully engage in any discriminatory behavior while at the client’s premises or while in any way connected with the appliance repair services
Any authorized representative/s of Central Coast Washing Machine and Refrigerator Repairs will not be engaged in any other business apart from the provision of the appliance repair services whilst on client premises, using the client’s facilities or is otherwise performing the appliance repair services
Any authorized representative/s of Central Coast Washing Machine and Refrigerator Repairs will not commit any criminal offence and/or breach any law or regulation which could adversely affect the interests of the client or the appliance repair services
Any authorized representative/s of Central Coast Washing Machine and Refrigerator Repairs if required by the client or if applicable will carry and display at all times appropriate Company information and provide such identification as is reasonably necessary
Central Coast Washing Machine and Refrigerator Repairs will not otherwise act in any manner which could disrupt or adversely affect the client, its reputation or at any time during the term disparage the client’s in any manner
Central Coast Washing Machine and Refrigerator Repairs will ensure where the client’s facilities are being utilized, those facilities are not used to:
- Publish any defamatory material;
- Without authority copy any plan, document, sketch or design which copying is unauthorized and breaches any intellectual property and/or
- Confidential Information belonging to the client or any other Person;
- Harass, bully or discriminate against any person;
- Without authority use or disclose or in any way publish any Confidential Information
- Access, download, print or disseminate in any way any pornographic material;
- Hold him or herself out as having any authority, entitlement, right or position which he or she does not have ;
- Do any act or thing which could be reasonably construed as misleading or deceptive or which is likely to mislead or deceive any person
Central Coast Washing Machine and Refrigerator Repairs covenants with the Client that:
- They will use Confidential Information for the benefit of the client and in the proper performance of the appliance repair services and will not disclose any Confidential Information to any person without the prior written consent of the client;
- They will not use or disclose any Confidential Information except to the extent permitted by the client for the purposes of properly performing their obligations
Central Coast Washing Machine and Refrigerator Repairs will not dispute or contest or assist any other Person in disputing or contesting the confidentiality of any Confidential Information and/or the rights of the client to have such information kept as Confidential Information
If at any time any authorized representative/s of Central Coast Washing Machine and Refrigerator Repairs use or access the client’s computers or computer network, then Central Coast Washing Machine and Refrigerator Repairs agree and acknowledge to the client that they will at all times observe and abide by the client’s Computer policy
Central Coast Washing Machine and Refrigerator Repairs undertakes and covenants with the client not to solicit or attempt to solicit any employees of the client with a view to inducing them to leave the employment of the client. Central Coast Washing Machine and Refrigerator Repairs will also not attempt to solicit any contractors or consultants engaged by the client during the Term or any part thereof
The client may terminate the appointment of Central Coast Washing Machine and Refrigerator Repairs for ongoing appliance repair services by giving written Notice to Central Coast Washing Machine and Refrigerator Repairs
The client may terminate the appointment of Central Coast Washing Machine and Refrigerator Repairs for ongoing appliance repair services whether or not there has been any breach by giving Central Coast Washing Machine and Refrigerator Repairs 30 day’s prior written notice to that effect whether or not the appliance repair services have been completed and such termination will not give rise to any claim for compensation or damages
Central Coast Washing Machine and Refrigerator Repairs can terminate its appointment for ongoing services with the client by giving 30 days written notice to the client whether or not the appliance repair services have been completed and such termination will not give rise to any claim for compensation or damages
Upon termination the client will be liable to pay Central Coast Washing Machine and Refrigerator Repairs for the appliance repair services provided upon termination
Where the Term is a shorter period than would otherwise be the case because it is terminated then Central Coast Washing Machine and Refrigerator Repairs will only be entitled to be paid for the appliance repair services fees for work done up until the date of such termination
The Parties acknowledge that the only relationship that the client and Central Coast Washing Machine and Refrigerator Repairs have is that Central Coast Washing Machine and Refrigerator Repairs is an independent contractor to the client
Neither Central Coast Washing Machine and Refrigerator Repairs nor any of its authorized representative/s may claim, or hold itself, himself/herself out to any person as having any relationship, authority, right or entitlement to represent or act as agent of the client or to have any interest or shareholding in the client’s Company at any time during or after the Term
The Parties must be in performance of all their obligations to each other act in good faith, co-operate and act reasonably towards each other.
